1. Introduction

DSIJ Private Limited (“DSIJ,” “we,” or “us”) provides its website(s), products, services, and content subject to the following Terms & Conditions (“Terms” or “Agreement”). By accessing or using DSIJ’s products, services, or content (“Products/Services/Content”), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use DSIJ’s website(s) or services.

2. License & Use

• Limited License
  DSIJ grants you a limited, non-exclusive, non-transferable, and non-assignable license to access and make personal, non-commercial use of DSIJ’s Products/Services/Content. Any other use, including resale, redistribution, or broadcast, is strictly prohibited unless expressly authorised by DSIJ in writing.
• No Retransmission of Information
  You may not resell, redistribute, or transfer the Products/Services/Content or use them in a searchable, machine-readable database without our prior written consent.

3. User Responsibilities

• Equipment & Internet
  You are responsible for procuring and maintaining all equipment and internet access required to use DSIJ’s Products/Services/Content. Any associated costs (e.g., telephone/internet fees, data charges, taxes) are solely your responsibility.
• Lawful & Authorized Use
  • You must not use DSIJ’s Products/Services/Content for any unlawful purpose.
  • You shall not share your login credentials or grant access to any unauthorized individual, group, or forum. If DSIJ discovers that you have shared paid content or access, DSIJ reserves the right to immediately terminate all your subscription(s) without refund.

4. Delays & Service Activation

• Delays
  DSIJ is not liable for any direct or indirect loss arising from service delays due to factors beyond its control (e.g., network outages, natural disasters, strikes, war).
• Activation
  • Print Magazine: For any print product, the default delivery mode is via POST. Please allow 4–6 weeks for your subscription to commence post receipt of payment.
  • Other Services: Please allow 4–6 working days for activation post receipt of payment.

5. Payments & Refunds

• Advance Payment
  • All subscriptions require 100% advance payment.
  • Subscription periods are updated after the date payment is realized.
• No Refund Policy
  Except as required by law or stated in a separate written agreement, DSIJ does not provide refunds once payment is made.
• Online Payments
  • Any credit/debit card details you provide are processed via a secure payment gateway.
  • DSIJ is not liable for unauthorized interception or hacking of any payment data.
• Magazine Lifetime Membership (If Applicable)
  • Transferable only to one legal heir.
  • Valid for 25 years or until the earlier of (a) the subscriber’s/legal heir’s lifetime, or (b) discontinuation of the service.
  • DSIJ may add or remove features without notice and assumes no liability in case of closure or suspension of service.

6. Liability & Disclaimers

• User’s Own Risk
  You agree that you use DSIJ’s Products/Services/Content at your sole risk. Content may include inaccuracies or typographical errors. DSIJ may make periodic improvements or changes.
• No Warranty
  • DSIJ’s Products/Services/Content are provided “as is” and “as available” without warranties of any kind, express or implied.
  • DSIJ specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Investment Risks
  • Any investment or trading decision based on DSIJ’s recommendations is subject to market risks.
  • DSIJ does not assure or guarantee any returns or profits.
  • Neither DSIJ nor its promoters, members, or employees shall be liable for losses resulting from investment decisions based on DSIJ’s recommendations.
• Limitation of Liability
  • To the maximum extent permitted by law, DSIJ will not be liable for any direct, indirect, punitive, incidental, or consequential damages arising out of the use or performance of its Products/Services/Content.
  • Your sole and exclusive remedy is to discontinue using DSIJ’s Products/Services.

7. Modification of Terms

DSIJ reserves the right to modify or update these Terms at any time without prior notice. Any changes will become effective immediately upon posting. You are encouraged to review the Terms periodically to stay informed about any modifications.

8. Third-Party Links

DSIJ’s website or Products/Services/Content may contain links to third-party sites or services. These linked sites are not under the control of DSIJ, and DSIJ is not responsible for their content or any changes/updates to them. Such links are provided for your convenience and do not imply endorsement or association.

9. Communication Services

DSIJ’s website or app may include communication tools such as bulletin boards, chat areas, forums, and more (“Communication Services”). By using these services, you agree to:

• Post only content that is lawful and relevant.
• Refrain from defamation, harassment, violation of others’ rights, or posting obscene or infringing materials.
• Not upload files that contain viruses or protected materials without permission.
• Not engage in unsolicited advertising or spam.

DSIJ reserves the right (but has no obligation) to monitor and remove content in its sole discretion.

10. Materials Provided to DSIJ

Any submission, feedback, or information you provide to DSIJ via its website or services may be used by DSIJ for its business purposes, including the right to copy, distribute, and publicly display such material. You retain ownership of any intellectual property rights you hold in your submissions.

11. Termination / Access Restriction

• Termination by DSIJ
  DSIJ, at its sole discretion, may terminate or suspend your access to its Products/Services/Content at any time without notice if you violate these Terms or any applicable law, or if your conduct is deemed harmful to the interests of DSIJ or other users.
• Survival of Provisions
  Certain provisions (e.g., disclaimers, limitation of liability, governing law) will survive any termination of this Agreement.

12. Consent to Communication

By subscribing to any package or offer, you expressly consent to be contacted by DSIJ personnel via email, phone calls, or SMS, including if your number is registered under Do Not Disturb (DND) service. If you do not wish to receive such communications, you may request to opt out via email at any time.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. You consent to the exclusive jurisdiction of the courts in Pune, Maharashtra, India, to resolve any disputes arising out of or related to these Terms.

14. General Provisions

• No Partnership: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and DSIJ.
• Entire Agreement: These Terms constitute the entire agreement between you and DSIJ regarding the use of DSIJ’s Products/Services/Content, superseding all prior or contemporaneous communications.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Notice: Any notices to DSIJ must be sent to service@dsij.in or via post to DSIJ’s registered address.

15. Copyright & Trademarks

• Ownership: All website design, text, graphics, the selection and arrangement thereof, and all software are © 2019 DSIJ Pvt. Ltd. or its suppliers. All rights reserved.
• Trademarks: Product and company names referenced may be trademarks of their respective owners. No right or license is granted by these Terms to use any trademark, service mark, logo, or name of DSIJ or any third party.
